1. Policy Statement

[Your Establishment's Name] is committed to maintaining a work environment free from sexual harassment. Sexual harassment in any form is strictly prohibited and will not be tolerated. All employees are entitled to a workplace that promotes mutual respect and professionalism.​ 

 

2. Definition of Sexual Harassment

Sexual harassment is defined as any unwelcome sexual advances, requests for sexual favors, or other verbal or physical conduct of a sexual nature when:​

  • Submission to such conduct is made either explicitly or implicitly a term or condition of an individual's employment.

  • Submission to or rejection of such conduct by an individual is used as the basis for employment decisions affecting such individual.

  • Such conduct has the purpose or effect of substantially interfering with an individual's work performance or creating an intimidating, hostile, or offensive working environment.​

 

3. Reporting Procedures

Employees who believe they have been subjected to sexual harassment are encouraged to report the incident promptly through any of the following channels:​

  • Manager: Report directly to your immediate supervisor or any managerial staff member.

  • Owner: Contact the owner of [Your Establishment's Name].

  • Human Resources: If applicable, reach out to the HR department.

  • Corporate Headquarters: For establishments with a corporate structure, contact the designated corporate office.

  • Internal Reporting Mechanism: Utilize any other internal reporting systems available within the organization.​
     

All reports will be handled confidentially to the extent possible, and information will be disclosed strictly on a need-to-know basis.​

 

4. Internal Complaint Process

Upon receiving a report of sexual harassment:​

  • Acknowledgment: The report will be acknowledged promptly.

  • Investigation: A thorough and impartial investigation will be conducted.

  • Resolution: Appropriate corrective actions will be taken based on the findings.

  • Feedback: The complainant will be informed of the outcome, ensuring transparency in the process.​

All employees are required to participate in annual sexual harassment prevention and active bystander training provided by the SAFE Bar Network.

  • Training: Covers definitions, examples, and legal provisions related to sexual harassment. Training focuses on industry-specific scenarios and manager responsibilities.​ 

 

Training materials are available in both English and Spanish.​

 

8. Policy Distribution

This policy will be provided to all employees within the first calendar week of their employment. Employees are required to acknowledge receipt of the policy in writing.
